Terms & Conditions​
1. General
These Terms & Conditions (“Terms”) govern the sale and purchase of artworks from Attila Konnyu (“Artist,” “we,” “us,” or “our”), operating as a business registered in the State of Florida, United States. By accessing our website or placing an order, you (“Customer,” “you”) agree to be bound by these Terms.
2. Eligibility & Age Restriction
By making a purchase, you represent and warrant that you are at least 18 years old and legally capable of entering into binding contracts under applicable law.
3. Originality & Availability
3.1. All artworks offered are original, one-of-a-kind creations by Attila Konnyu. Once an artwork has been sold, it will not be reproduced or made available again.
3.2. Availability is subject to change without notice. While we strive to keep our listings current, we cannot guarantee real-time accuracy. Customers are encouraged to inquire about the availability of specific works.
3.3. We do not accept custom orders or commissions.
4. Shipping & Delivery
4.1. Artworks are shipped as rolled canvas in protective packaging. Unless otherwise stated, artworks are shipped without stretcher bars or frames.
4.2. Shipping times vary depending on destination and carrier. Any estimated delivery dates are provided for convenience only and are not guaranteed.
4.3. Risk of loss and title pass to the Customer upon our delivery of the artwork to the carrier. We are not responsible for delays, damages, or losses incurred during transit. Customers are encouraged to purchase shipping insurance where available.
5. Purchases, Cancellations & Returns
5.1. All sales are final. Once the purchase and shipping process has begun, no exchanges, modifications, cancellations, or returns are permitted.
5.2. Due to the unique nature of original artworks, no refunds or money-back guarantees are offered. Complaints or claims cannot be processed after shipping, except as required by applicable law.
5.3. Customers are responsible for providing accurate shipping information at the time of purchase. We are not liable for delivery failures caused by incorrect or incomplete information provided by the Customer.
6. International Customers
6.1. Customers outside the United States are responsible for all customs duties, import taxes, and fees imposed by their jurisdictions.
6.2. We are not liable for delays or additional costs resulting from customs clearance procedures.
7. Intellectual Property
All content on this website, including images, artwork photographs, text, and design, is the intellectual property of Attila Konnyu and is protected by copyright and other applicable laws. No content may be copied, reproduced, distributed, or used for commercial purposes without prior written consent from the Artist.
8. Disclaimer of Warranties
All artworks and related services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, we disclaim all liability for indirect, incidental, special, or consequential damages arising out of or in connection with the purchase, shipment, or use of artworks. In no event shall our total liability exceed the purchase price actually paid by the Customer.
10. Indemnification
You agree to indemnify, defend, and hold harmless Attila Konnyu, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your violation of applicable laws, or your misuse of our website or artworks.
11. Force Majeure
We shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, civil unrest, labor disputes, pandemics, epidemics, governmental actions, or interruptions of transportation or utilities.
12. Severability & Waiver
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
14. Entire Agreement
These Terms constitute the entire agreement between you and Attila Konnyu regarding the purchase of artworks and supersede any prior understandings, representations, or agreements, whether oral or written.
